1. ACCEPTANCE OF TERMS

By accessing or using our website or services, you agree to be bound by these Terms & Conditions. If you do not agree, do not proceed with our services.

2. SERVICES OFFERED

Digit Growth Solutions provides integrated digital marketing and automation services, specifically:

• Meta Ads Management: Strategy, campaign creation, media buying, and optimization on Facebook and Instagram

• Funnel Development: Custom landing pages, sales funnels, lead capture systems, and CRM/email integration

• AI Automation: Configuration of backend workflows and AI-driven lead management, email follow-ups, and operational efficiencies

All services are detailed in a signed Service Agreement or Proposal per client.

3. CLIENT RESPONSIBILITIES

Clients agree to:

• Provide timely access to Meta ad accounts, CRM tools, and relevant third-party systems

• Submit branding assets, copy, and approvals by set deadlines

• Maintain compliance with advertising policies (e.g. Meta's policies)

• Respond within 3 business days to feedback, review items, and decisions

Delays or failures to meet these obligations may result in project delays or added fees.

4. FEES AND PAYMENTS

• All prices are in AUD and exclusive of GST

• Payments are processed securely via Stripe

• All payments are non-refundable unless otherwise agreed in writing

• Late payments incur a 5% monthly fee

• Chargebacks filed without contacting us first will void the agreement and may lead to legal enforcement and service suspension

Payment is required to activate service delivery and retain access to deliverables.

5. PERFORMANCE DISCLAIMER

Marketing results are influenced by various external factors. Therefore:

• We do not guarantee specific ROI, leads, or sales volumes

• Projections or benchmarks are estimates based on previous outcomes and industry averages

6. INTELLECTUAL PROPERTY

All content, funnels, and strategy documents remain the property of Digit Growth Solutions until full payment is received. Upon payment, clients receive a non-exclusive, business-use license to use the deliverables.

7. TERMINATION POLICY

• Either party may terminate the agreement with 30 days’ written notice

• If the client cancels early, all outstanding fees remain payable

• If a client becomes unresponsive for 14+ days, the project is placed on hold and may be archived without refund

8. DISPUTE RESOLUTION

Prior to initiating chargebacks or legal action, the client agrees to:

1. Notify Digit Growth Solutions via email (hello@digitgrowth.io)

2. Allow up to 10 business days for us to address and resolve the matter

Disputes that escalate without this process will be considered a breach of agreement.

9. MODIFICATIONS

These Terms may be updated from time to time. Continued use of our services after changes implies acceptance of the revised terms.

10. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia. Any legal matters will be settled in the courts of Victoria.
